Sealing Your Criminal Record

A Florida criminal record can be sealed or expunged. The net effect is to accomplish the same thing; no one can legally obtain access to your criminal arrest record without a Court Order. In a Florida expungement, the records are physically destroyed. Sealing Florida criminal records is exactly how the name sounds, your arrest record is literally sealed in an envelope, and locked away and no one has access to it. Where you live in the state does not matter. Central Florida criminal records can be sealed, and Broward County criminal records are subject to the same procedures for sealing or expunging as a criminal record in Orlando or anywhere else in Florida. It is not up to you or where you live if a Florida arrest record can be sealed or expunged. That is determined by the outcome of your court case.

Generally, only cases where you have been found “Not Guilty”, or where the charges have been dismissed, or were dropped, can be expunged. In cases where you have pled guilty, or nolo contendere (No Contest) or have been found guilty, but rather than a conviction you received an adjudication of guilt "withheld” you can apply to seal your Florida criminal record. However only if the adjudication of guilt was withheld and the offense is not one listed on the exceptions page, can your Florida criminal arrest record be sealed.
