Florida - Expunge Criminal Record FAQ's
Q. What is the difference between sealing and expunging a Florida criminal record?
A. In terms of the desired outcome there is very little difference between sealing and expungement. In an expungement the Florida criminal record is actually destroyed, in sealing, the record is sealed, but remains physically intact. But either one will result in the public no longer having access to your criminal record.
Q. Is it easier for someone to get to see a “sealed” record than an expungement?
A. No. Both are legal orders issued by the court. In either a sealing or expungement it is illegal for anyone with knowledge of your record to even discuss or divulge it. In either case it requires a court order to see sealed or expunged records.
Q. Can I get a past conviction expunged from my criminal record?
Expunging or sealing a criminal record does not apply to convictions. However sealing or Expunging Florida Criminal Records can occur under Florida law if:
- It is the first time you have applied to have a Florida criminal record sealed or expunged
- You were arrested but no charges were filed
- You were arrested but the charges were later dropped
- You were arrested and the court dismissed the charges
- You were charged, plead guilty, and received a withhold of adjudication, and your offense is not one listed on the exception page of this website
- You were charged, plead no contest (nolo contendere), and received a withhold of adjudication, and your offense is not one listed on the exception page of this website
- You were charged, found guilty by a jury, and received a withhold of adjudication, and your offence is not one listed on the exception page of this website
- You are not under any type of Court Supervision
However we can attempt to get a prior conviction set aside, then apply to get that record sealed or expunged.
Q. How much will it cost to have my Florida criminal record expunged?

Q. Is there any time limitation on sealing or expunging past arrest records?
A. No
Q. How long will it take to have my name removed from the public records once the process of sealing or expunging has begun?
A. All cases are different. It can take several months. But our office of expert Florida expungement attorneys knows how to speed up the process. Our clientele average 6 months to have their records sealed or expunged successfully once the process has been started.
Q. Can I receive an expungement more than once?
A. No, according to Florida law you may only obtain an expungement or sealing of a criminal record one time. Under certain circumstances cases of mistaken arrest may be expunged, and not qualify as your one opportunity for expunging, as may certain types of Juvenile offenses.
Q. Is there ever a time when I would have to reveal that I had a Florida criminal record expunged or sealed?
A. There are certain circumstances under which even if you have had your Florida criminal record expunged, you may be required to divulge its existence. These include but are not limited to: when you are applying for work with a criminal justice agency, apply for membership in the Florida Bar, you are a defendant in a criminal case, you are applying to work for The Dept. of Children and Families, or any of its licensed contractors, or applying for work that will put you into direct contact with children, the elderly, or developmentally disabled.
